Description
Assume that the legal age to contract in Florida is 18. Henry Long was a child prodigy who finished high school at age 15. However, after having trouble adjusting to college, he returned home and, at 17, was married and living in near poverty with his 17-year-old wife and their 6-month-old child. Penniless and jobless, Hank decided to return to the hobby that had led him to graduate early-new multimedia technology. He required a special new connector device that connected his custom-made computer, stereo, TV, MP3 player, and several other devices. Flank used this connector to experiment and blend all the technologies. The device cost about $5,000.00, which he and his wife had no hope of affording. He contracted with his local BEST-TEK store, which was running a special-no credit check, no money down. After two months of working with the device and disassembling it, he determined a way to make an even better device with more features, and he sold the rights to a major electronics company. Still 17, Hank immediately took the device he purchased, in a questionable stage of re-assembly, back to BEST-TEK and voided the contract, stating that he was under the age of majority to contract.
(1) What claims does BEST-TEK have against Hank?
(2) If Hank returned the device 6 months after his 18th birthday, would he able able to void the contract?
