Vicarious Liability
Where a tortfeasor’s primary intention is to harm his employer by his tort, his
employer should not be vicariously liable for that tort. Public policy should insist that a
court should not facilitate, (or complete), the wrong against the employer- An appellate
court must overturn the finding on vicarious liability in Various Claimants v WM
Morrisons Supermarket Plc (Rev 1) [2017] EWHC 3113 (QB)."
